Additional Product Exclusions Granted for Section 301 Tariffs

The United States Trade Representative (USTR) has announced additional exclusions requests granted to products on Lists 1, 2, and 3 of the Section 301 action on goods made in China. All exclusions are available for any product that meets the description in the Annex of each notice.

The USTR will be accepting Section 301 List 3 product exclusion requests through its online portal until September 30, 2019. To obtain a duty refund your product must meet the very-specific descriptions attached to each tariff number.

List 1: The exclusions granted for List 1 include 310 specially prepared product descriptions which can be found on the September 20th notice. These exclusions will apply to the July 6, 2018 effective date of the $34 billion action, and will extend for one year after the publication of the notice. List 1 goods that meet the specially prepared product exclusion descriptions are eligible for a duty refund. A post summary correction (PSC) or duty protest is required.

List 2: The exclusions granted for List 2 include 89 specially prepared product descriptions which can be found on the September 20th notice. These exclusions will apply to the August 23, 2018 effective date of the $16 billion action, and will extend for one year after the publication of the notice. List 2 goods that meet the specially prepared product descriptions are eligible for a duty refund.

List 3: The exclusions granted for List 3 include 38 specially prepared product descriptions which can be found on the September 20th notice. These exclusions will apply to the September 24, 2018 effective date of the $200 billion action, and will extend until August 7, 2020. List 3 goods that meet the specially prepared product descriptions are eligible for a duty refund.

If your company determines that your goods meet the specific product descriptions set forth in the Annex, you may be eligible to file a claim for a duty refund. Contact your KRIEGER Worldwide Brokerage Representative to request a Post Summary Correction or a duty protest to claim the refund.
